Yigal Mesika files patent infringement lawsuit against Sean Bogunia
Magic creator, Yigal Mesika filed a lawsuit claming that defendant Sean Boguina infringes on his intellectual property with his effect “iThread” and the upcoming “iThreadX”.
According to the filing made known on IP Trademark Attorney : “attempts were made to settle the matter……negotiations went up in a cloud of smoke” .
We put up an article regarding Magic & Copyrights a while ago and this case is a very first of its kind in which legal means were employed to safeguard one’s trade secrets.

I have used nothing of his.
Dear Sean:
This will record the present status of your case number CV09-1580 JFW
(SSx) from my perspective. I have reviewed all of the information you
have provided and the information I have obtained from other sources and
have reached the following conclusions: (1) you have a valid basis to
argue both invalidity and/or noninfringement of USP 7,311,609 as applied
to iThread or iThreadx; (2) you also have a strong argument that the
patentee committed fraud in obtaining the patent since he failed to
disclose the closest prior art of which he must have been aware; and
(3) you also have evidence that the patentee misused his patent and may
therefore be liable for actual and punitive damages. The foregoing is
subject to further consideration as more facts come to light.
After discussing the case with Arthur Vry, I concur with his view that
the best course of action to follow at the present time is attempt to
get an extension of time for filing an Answer to the Complaint and in
the interim try to convince the Plaintiff drop the case. This approach
is largely influenced more by an attempt to reduce the cost of trying
the case than by the weakness of your position. In my opinion Mr. Vry
is best positioned geographically as well as personnally to carry out
the foregoing strategy.
